This communication ,in accordance with art.13 of EU Regulation 2016/679,is made by OLTREMARE MODA s.a.s di GUADAGNIN PAOLO & C.based in Z.I.-Via Delle Industrie 14,30025 FOSSALTA DI PORTOGRUARO (VE), as Data Controller, to whom who will access to our website and will fill out our CONTACT FORM licensing us to process their personal data.

The provision of data is optional but, without data, it will be not possible processing and carrying out requests.

Personal data ,supplied by our website visitors/users, will be processed to develop and carry out their requests.

Personal data,supplied by website visitors, will be lawfully processed to carry out pre-contractual measures and to performance a contract(article 6(1) lit. b GDPR 679/2016) as requested by the same visitor(with contact form).

Personal data,supplied by vistors/users, will be not transferred to third parties. Personal data could be communicated to employees and Controller collaborators that will process them according to Controller instructions.

Responsible for processing

In case of need,for activities concerning website maintenance,personal Data could be processed by employees of W3 DESIGN s.a.s. di Fabbro Silvano & c., that has been appointed as Responsible for processing in accordance with art. 28 of EU Regulation 679/2016.

Visitors/users personal data will be processed for the time strictly needed to fulfill the above mentioned purposes.

In accordance with art.13(2) ,and from 15 till 21 of EU Regulation, the Data Subject shall have the below rights:

    • Confirmation as to wheter or not personal data concerning him or her are being processed;
    • The purposes of the processing;
    • The categories of personal data concerned;
    • The recipients or categories of recipients to whom the personal data have been or will be disclosed;
    • Where the personal data are not collected from the data subject,any available information about their source;
    • The existence of automated decision –making,included profiling;
    • Copy of personal data stored.
  2. Right to rectification and right to have incomplete personal data completed.
  3. Right to erasure(right to be forgotten) where one of the following grounds applies:
    • The personal data are not longer necessary in relation to the purposes for which they were collected or otherwise processed;
    • The data subject withdraws consent to which the processing is based and where there is no other legal ground for the processing;
    • The Data Subject objects to the processing and there are no overriding legitimate grounds for the processing;
    • The personal data have been unlawfully processed;
    • The personal data must be erased for compliance with a legal obligation in Union or member State law to which the controller is subject.
      Where the Controller has made personal data public,and is obliged to erase the personal data, he has to inform other controllers processing the personal data that the Data Subject has requested erasure by such controllers of any link to, or copy or replication.
  4. Right of restriction of processing when:
    • The accuracy of personal data is contested by the Data Subject, for a period enabling the controller to verify the accuracy of the same personal data;
    • The processing is unlawful and the Data Subject opposes the erasure of personal data and requests the restriction of their use instead;
    • The Controller no longer needs the personal data for the purposes of the processing, but they are required by the Data Subject for the establishment,exercise or defence of legal claims;
    • The Data Subject has objected to processing pending the verification whether the legitimate grounds of the Controller override those of the Data Subject.

  6. Right to data portability:
    The Data Subject shall have the right to receive his or her personal data in a structured commonly used and machine-readable format. Data subject shall have the right to transmit those data to another controller ,as long as the processing is based on consent or on a contract and the processing is carried out by automated means.
    Furthermore the Data Subject shall have the right to have personal data transmitted directly from one controller to another,where technically feasible.
  7. Right to object:
    The Data Subject shall have the right to object, at any time, the processing of his or her personal data especially when:
    • the Controller process personal data on grounds of his legittimate interests, after notification of opposition reasons;
    • personal data are processed for direct marketing purposes;
  8. each data subject shall has the right not to be subject to a decision based solely on automated processing, including profiling, except when it is necessary for entering into,or the performance of,a contract between the Data Subject and a Data Controller, it is authorized by Union or a Member State law to which the Controller is subject, it is based on the Data Subject‘s explicit consent.
  9. Right to withdraw data protection consent
    each Data Subject shall have the right to withdraw the consent to processing personal data at any time. The personal data, if they don’t have grounds in a different legal basis ( for example, fulfillment of a legal obligation or contract performance), they must be canceled by the Controller.
